1. Introduction

Welcome to PlayPesa ("the Platform", "we", "us", "our"). These Terms and Conditions ("Terms") govern your use of the PlayPesa website, mobile applications, and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

PlayPesa is operated by PlayPesa Limited, a company registered in the Republic of Kenya, licensed and regulated by the Betting Control and Licensing Board (BCLB) of Kenya under License Number BK/0047291.

2. Eligibility

  • You must be at least 18 years of age to use our Services. By creating an account, you confirm that you are 18 years or older.
  • You must be a resident of or physically located in a jurisdiction where online betting is permitted by law.
  • You must not be a person who is self-excluded or excluded from gambling services.
  • You must provide accurate, complete, and current information during registration and keep your account information up to date.
  • You are solely responsible for ensuring that your use of our Services complies with all applicable laws and regulations in your jurisdiction.

3. Account Registration

To use certain features of the Platform, you must create an account by providing a valid phone number, username, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Each person may only maintain one (1) account. Multiple accounts per person are strictly prohibited and may result in account termination and forfeiture of funds.
  • You must not allow any other person to access or use your account.
  • You must immediately notify us if you become aware of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our discretion if we suspect fraudulent activity, multiple accounts, or violation of these Terms.

4. Deposits and Withdrawals

All financial transactions on PlayPesa are conducted in Kenyan Shillings (KES).

  • Deposits: The minimum deposit amount is KES 100. Deposits can be made via M-Pesa, Airtel Money, or other supported payment methods. Deposits are credited to your account upon confirmation of payment.
  • Withdrawals: The minimum withdrawal amount is KES 100. Withdrawals are processed to your registered M-Pesa number. Processing times are typically within 24 hours but may take up to 72 hours during peak periods.
  • Daily Limits: Daily withdrawal limits of KES 150,000 apply. Higher limits may be available upon verification.
  • We reserve the right to request identification documents before processing withdrawals for fraud prevention and regulatory compliance purposes (KYC — Know Your Customer).
  • Funds in your account do not earn interest.

5. Betting Rules

All bets placed on PlayPesa are subject to the following rules:

  • All bets are final once placed and confirmed. Bets cannot be cancelled or changed after placement unless explicitly permitted by the game rules.
  • In the event of a system malfunction, network disruption, or any technical error, PlayPesa reserves the right to void all bets affected by such occurrence.
  • The maximum payout per single bet is KES 5,000,000 unless otherwise stated.
  • PlayPesa reserves the right to limit or refuse any bet at its sole discretion.
  • Any exploitation of software bugs, glitches, or loopholes will result in immediate account suspension and forfeiture of winnings obtained through such exploitation.

6. Provably Fair Gaming

PlayPesa uses a provably fair system for its crash game and other applicable games. Each round is determined by a combination of server seed, client seed, and nonce that can be independently verified by players. The algorithm is publicly documented, and players can verify the fairness of any round after it concludes.

We do not manipulate game outcomes. The crash point for each round is determined before any bets are placed for that round.

7. Responsible Gaming

PlayPesa is committed to responsible gaming. We encourage all players to:

  • Set personal deposit, loss, and time limits.
  • Take regular breaks from gaming.
  • Never bet more than you can afford to lose.
  • Seek help if you believe you may have a gambling problem.

Players may request self-exclusion for periods of 24 hours, 7 days, 30 days, or 6 months by contacting our support team. During self-exclusion, you will be unable to access your account or place bets. For more information, visit our Responsible Gaming page.

8. Prohibited Activities

The following activities are strictly prohibited:

  • Using automated software, bots, or scripts to interact with the Platform.
  • Collusion with other players to manipulate games or outcomes.
  • Money laundering or using the Platform for any illegal financial activity.
  • Creating multiple accounts or using false information.
  • Exploiting technical vulnerabilities, bugs, or errors in the Platform.
  • Using VPNs or proxy services to circumvent geographical restrictions.
  • Engaging in any activity that disrupts or interferes with the Platform's operations.

9. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and code, is the property of PlayPesa Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, PlayPesa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from or related to our Services shall not exceed the amount deposited by you in the preceding 12 months.

PlayPesa is not responsible for any losses resulting from:

  • Internet connectivity issues or service interruptions.
  • Errors or omissions in the Platform caused by factors beyond our reasonable control.
  • Unauthorized access to your account due to your failure to protect your credentials.
  • Any actions taken by third-party service providers.

11. Dispute Resolution

If you have a complaint or dispute regarding any bet or transaction, you must contact our support team at support@playpesa.co.ke within 30 days of the event giving rise to the dispute. We will investigate and respond within 14 business days.

If the dispute is not resolved to your satisfaction, you may escalate the matter to the Betting Control and Licensing Board (BCLB) of Kenya.

12. Amendments

PlayPesa reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of our Services after any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes via email or in-platform notifications.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
